General Terms and Conditions of Purchase

The general terms and conditions of the website www.luxe-jeans.com/cz constitute a binding agreement between the customer and the online store Luxe Jeans and are composed based on EU laws related to online business.

Acceptance of these terms is MANDATORY before finalizing the order.

The website operator is the company INTEKO D.O.O. (hereinafter referred to as the "company"), Slap 3/e, 5271 Vipava, Slovenia.

The general terms and conditions define and explain the rights and obligations of customers when ordering products sold on the website www.luxe-jeans.com/cz (hereinafter Luxe-Jeans).
Luxe-Jeans online store will handle your personal data obtained due to the need for making an online purchase in accordance with the existing legislation. The processing of personal data is more specifically defined in the privacy policy.

Shopping on the Luxe-Jeans website is available to both physical and B2B customers.

Product prices are clearly stated on the website and include VAT. All additional costs related to the choice of payment method or delivery are clearly visible and will be communicated to you before confirming the order.

The conditions under which you can withdraw from the contract are described in more detail below.

The customer is required to respect intellectual property on the Luxe-Jeans website, as defined in the following general terms.

All content presented on the website (i.e., images, video content, texts, etc.) is protected and may not be used for any other purpose than viewing the website and making purchases. Content may be used for other purposes if the Luxe-Jeans website grants written permission. In case of misuse, the Luxe-Jeans online store will report the case to the relevant authorities.

By accessing services on the website www.luxe-jeans.com/cz, the customer accepts and agrees to all provisions of the general terms listed below. If the customer disagrees with the written terms and conditions, they are requested to stop accessing the website.

The customer is bound by the general terms in effect at the time of purchase. The customer is specifically notified upon placing an order and must confirm the general terms. Please read the general terms carefully before completing the purchase on the Luxe-Jeans website. By placing an order, the customer confirms their familiarity with the general terms.

2. TERMS USED IN THE GENERAL TERMS AND CONDITIONS
"Website" refers to the website www.luxe-jeans.com/cz
"Customer" refers to any individual or B2B entity that makes a purchase on the Luxe-Jeans online store.

3. ORDERING PROCESS AND ORDERING TERMS ON THE WEBSITE
The customer can make an online purchase on the Luxe-Jeans online store only if they fully agree with the general terms and conditions. Partial agreement with the terms is not possible. By confirming the general terms, the customer confirms that they are fully familiar with the content, understand, and agree with it. If the customer disagrees with the general terms, they are advised not to complete the order.

Luxe-Jeans website strives to ensure that product descriptions, images, and video content are as accurate as possible, but we allow the possibility of errors, which will be corrected by the Luxe-Jeans online store as soon as possible.

3.1. PURCHASE AGREEMENT
The purchase agreement between the Luxe-Jeans website and the customer is concluded when the customer accepts and confirms the general terms on the website www.luxe-jeans.com/cz and submits an order. When the Luxe-Jeans website receives and confirms the order, the agreement is concluded. From this moment, all prices and other purchase conditions stated in the general terms are confirmed and apply to both the customer and the Luxe-Jeans website.

After submitting the order, the customer will receive an email confirming whether the order has been accepted or rejected.

3.2. PRICES AND TAXES
All product prices displayed on the Luxe-Jeans website are marked in Czech Korunas and include 21% VAT. Prices do not include shipping costs or payment method fees. All additional costs are clearly shown and summarized in the shopping cart before confirming the order.

Product prices are valid at the time the order is placed and are not predetermined; they are only valid until they are changed. The price listed for each product is the final selling price at the time the order is placed and cannot be changed after the order is confirmed.

We reserve the right to change prices without prior notice and to correct errors in prices or written content. Any errors will be corrected as soon as possible, and we apologize in advance for any mistakes.

Discounts and other promotions are generally not cumulative unless explicitly stated otherwise.
Promotions are time-limited and valid until stock runs out or until a date specified by the Luxe-Jeans website. The validity period of a particular promotion is always stated with the promotion.

The customer has no right to request a promotional price if the promotion period has expired or the product is out of stock.

The shipping cost is listed in the shopping cart before finalizing the order.

3.3. PAYMENT METHODS
The Luxe-Jeans online store offers the following payment methods:
• Payment with cash on delivery
• Payment by credit card
• Payment via PayPal
Payment through online payment methods is secure and protected against misuse and abuse of customer’s personal and banking data.
By choosing a particular payment method, additional fees may apply. The customer will be specifically informed about the occurrence of such fees during the purchase process. The customer guarantees to fully settle their obligations to the Luxe-Jeans website according to the chosen payment method and the payment due date. The customer explicitly confirms that they are aware that their obligation to the Luxe-Jeans website includes the cost of the ordered products as well as shipping costs and any costs related to the chosen payment method.
In case the customer does not settle their obligations within 30 working days from the due date, the Luxe-Jeans website reserves the right to use all available legal means to collect the outstanding amount. The customer must reimburse any costs related to the collection process.

3.4. VALIDITY OF OFFERS
The offers on the Luxe-Jeans website are limited by time and quantity. The quantities of products in stock and the estimated delivery times published with each offer and product are for informational purposes and may change without prior notice.

3.5. ORDER VALIDITY AND CANCELLATION
An order is considered final and complete when Luxe-Jeans sends an email confirmation of the order to the customer’s email address, which was provided when the order was placed.

In this email notification, the products and quantities selected by the customer, the price, and other necessary information for order completion are stated.

Accepted orders are considered irrevocable and will be executed unless the customer notifies Luxe-Jeans of a change or cancellation within 1 hour of placing the order via email at info@luxe-jeans.com. If the notification is sent within 1 hour of placing the order, the order change or cancellation will be considered. The customer agrees that an approved order change will be treated as a new order for which the customer is required to pay all related costs, including the product price, delivery, and payment method fees.

The customer may request a change to the order via the above email address, but Luxe-Jeans cannot guarantee that changes will always be possible.

The Luxe-Jeans website reserves the right to refuse any subsequent order change if it determines that it cannot execute the order under the specified conditions and details available to it and is not responsible for any damages caused to the customer as a result of such a refusal.

3.6. DELIVERY AND RECEIPT OF GOODS
We strive to prepare and ship all orders quickly. The estimated delivery time is 3 - 7 business days. In case of a longer delivery time or if the desired item is out of stock, the Luxe-Jeans website will notify the customer of the changed delivery time by email.

The Luxe-Jeans website reserves the right to notify the customer within 24 hours of order confirmation if unforeseen problems arise related to delivery or other justified reasons (e.g., the product is out of stock or the price was incorrectly specified) and, in such cases, may cancel the order. If the customer has already paid for the product, Luxe-Jeans will refund the purchase amount.

3.7. PRODUCT RETURNS
We strive to create the best shopping experience for the customer, but we understand that sometimes a product may not meet expectations and needs to be returned or complained about.

In accordance with EU consumer protection laws, the customer can withdraw from the contract with the Luxe-Jeans website within 14 days of receiving the package without having to state a reason for the withdrawal.

If the customer wishes to return a product, they must complete a return form and provide all required details (order number, name and surname, returned products, and the correct IBAN account). For further instructions regarding product returns, please contact us at info@luxe-jeans.com.

The 14-day withdrawal period does not apply to B2B customers.
Uncollected packages: By placing an order, the customer accepts the general terms and agrees to receive and pay for the ordered package. If the customer does not pick up the package, causing additional unnecessary costs for Luxe-Jeans related to the handling of the returned package (employee working hours, packaging, double postage), Luxe-Jeans may charge the customer for the incurred costs in the total amount of 500 CZK.
If you decide to return an item, please consider the following:
1. The returned item must be in the same condition as when you received it.
2. The item must be returned unworn and unwashed, in its original packaging with all attached labels. Otherwise, we reserve the right to reject the return according to our terms and conditions.
3. If the product is returned in a condition different from how it was received, the online store Luxe-Jeans reserves the right to reduce the refund value based on the following price list:
◦ Dirty item: deduct 15€ from the purchase price
◦ Wrinkled item: deduct 10€ from the purchase price
◦ Damaged/destroyed item: no refund

4. Refund: The purchase price will be refunded to the customer within the statutory period of 14 days from the receipt of the package at our main warehouse in Slovenia.
Refunds depending on the chosen payment method:
◦ Cash on delivery: Money will be refunded to the IBAN account provided by the customer on the return form.
◦ Credit card payment: Money will be refunded to the credit card used for the order payment.
◦ PayPal payment: Money will be refunded to the PayPal account used for the order payment.
If the order was paid on delivery, the customer must provide the correct IBAN account number (the number of digits required is specified on the return form). Otherwise, the customer will be charged a fee of 150 CZK for resolving the issue with the bank and for additional costs related to the re-transfer.
Return address: The customer bears the full cost of returning the items. Items can be returned via any delivery service. However, we recommend choosing the most cost-effective delivery option with package tracking and keeping the proof of the tracking number until the refund process is completed. The tracking number of the returned package is necessary for tracking the return in case the package is lost.
IMPORTANT! The customer must not return the package to a Parcel Locker, but to the address provided on the return form or listed below. If the customer returns the package to a Parcel Locker, it will be returned to the customer's address.

5. Complaints
In the case of a wrong or damaged item, Luxe-Jeans apologizes in advance. The complaint will be resolved as soon as possible.
In the case of a complaint, the customer must notify Luxe-Jeans via the email address info@luxe-jeans.com and send photographic evidence clearly showing the defect. The responsible person will review the evidence and inform the customer whether the complaint is approved. If the complaint is approved, the customer should indicate the reason for return as "The product is damaged/dirty" on the return form.

3.8. CONDITIONS OF WITHDRAWAL FROM THE CONTRACT
The customer has the right to withdraw from the contract within 14 days of receiving the goods.
The withdrawal period will expire after 14 days from the day the customer, or a third party designated by the customer, other than the carrier, acquires physical possession of the goods.
To exercise the right of withdrawal, the customer must inform Luxe-Jeans of their decision to withdraw from the contract by an unequivocal statement (e.g., a letter sent by post, fax, or email) before the withdrawal period has expired.

To meet the withdrawal deadline, it is sufficient for the customer to send their communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

3.8. TECHNOLOGICAL MEANS THAT ENABLE RECOGNITION AND CORRECTION OF ERRORS BEFORE SUBMITTING AN ORDER
Before submitting an order, the user (buyer) is enabled, via a graphical user interface, to immediately, easily and without problems:
- see and review which products he has selected and added to the shopping cart,
- see and review the price of an individual product and the total price of the entire selected quantity of an individual product,
- change the selected quantity of an individual product and calculate the new price of the thus changed quantity,
- remove selected products that he does not want to buy from the shopping cart and
- calculate the corresponding tax, according to the tax rate applicable to the selected product and its price (tax base).

Before confirming the order, the user (buyer) is enabled, via a graphical user interface, to immediately, easily and without problems:
- change the selected place of delivery,
- review and confirm individual changes to the order. With final confirmation, the buyer places the order,
- The Luxe-Jeans website sends a confirmation of receipt of the order to the buyer's email address.

The order is stored in electronic form on the provider's server.

3.9. LIMITATION OF LIABILITY
The Luxe-Jeans website strives to ensure the accuracy and correctness of the information published on the website. However, product features, prices, or delivery times may change before they can be updated on the website. In such cases, the customer will be promptly notified and will be able to accept the new terms, exchange the product, or cancel the contract.
The Luxe-Jeans website is not responsible for the content of product reviews written by website visitors on social media. Luxe-Jeans reserves the right to delete posts from its Facebook and Instagram pages that contain obvious falsehoods, are inappropriate, misleading, or offensive. Luxe-Jeans is not responsible for the information in reviews and disclaims any liability arising from the information provided in reviews.
Luxe-Jeans reserves the right to disable the website or restrict access to it due to technical or other issues and maintenance, which may result in the unavailability or obstruction of the online store. Luxe-Jeans is not responsible for any damages or costs incurred by the customer due to the cessation, malfunction, or hindrance of the website's operation. We do not guarantee the accuracy, completeness, or correctness of the content published on the website, nor do we accept responsibility for any damage that may result from reliance on the published content.
In case of technical issues on the website, we reserve the right to cancel orders affected by the technical error, and we will not be liable for any compensation for possible damages in this regard. If orders are canceled, we will inform you as soon as possible and notify you of the next steps.

3.10. COMPLAINTS AND DISPUTES
The Luxe-Jeans website respects the applicable consumer protection laws and strives to fulfill its duty to ensure an effective system for handling complaints.

The Luxe-Jeans website makes every effort to resolve any disputes amicably. The process of handling consumer claims is confidential. If an amicable resolution is not possible, the competent court in Ajdovščina will have jurisdiction over the dispute.

3.11. OUT-OF-COURT DISPUTE RESOLUTION
In accordance with the provisions of the relevant legislation, Inteko d.o.o. does not recognize any pre-designated entity for out-of-court consumer dispute resolution as competent to resolve consumer disputes that may arise under the applicable Consumer Dispute Resolution Act.
Inteko d.o.o., which operates an online store within the EU, in accordance with the provisions of the relevant legislation, publishes an electronic link to the platform for online dispute resolution (ODR). The platform is available to consumers via the following electronic link: http://ec.europa.eu/odr.
This regulation is based on the Consumer Dispute Resolution Act (Official Gazette of the Republic of Slovenia, No. 81/15), Regulation (EU) No. 524/2013 of the European Parliament and Council on online consumer dispute resolution, and amendments to Regulation (EC) No. 2016/2004 and Directive 2009/22/EC.

3.12. DELIVERY OF PACKAGES TO EU COUNTRIES
An order on the Luxe-Jeans website can be placed by any customer with permanent or temporary residence in any of the EU countries. However, such an order will only be delivered if the delivery address is in a country where the Luxe-Jeans website operates an online store and has a contract with a delivery service. The customer will be informed via email about the possibility or impossibility of shipping the package to other countries.

4. INTELLECTUAL PROPERTY
The trademark "LUXE JEANS" is a protected trademark owned by INTEKO D.O.O. Therefore, all materials, including texts, graphics, images, videos, etc., that are part of the website are intellectual property and are protected in accordance with the industrial property law and/or the copyright law.
By using the website, the user does not acquire any intellectual or other rights regarding the materials mentioned above.
The use of the website in a manner that violates the intellectual property rights of the Luxe-Jeans website (copying, imitating, or using any content on the Luxe-Jeans website) is prohibited.
Without the written consent of the Luxe-Jeans website, any reproduction, distribution, and/or use of any element of the website, including the logo and the name "Luxe-Jeans" itself, is prohibited. The user must not delete, cover, prevent reading, or alter trademarks, copyright notices, or any other markings relating to intellectual property rights. It is also prohibited to copy, trade, distribute, modify materials, or create derivative works based on the materials available on the website without prior written consent from the service provider.
The service provider, upon becoming aware of a violation of intellectual property rights and/or copyright, will take appropriate legal action against the infringing party and initiate all procedures provided for in these general terms and conditions.

5. FINAL PROVISIONS
The Luxe-Jeans website reserves the right to amend these general terms and conditions. Each document is marked with the date of the beginning of the validity of its provisions. By continuing to use the website after the general terms and conditions have been changed, the customer agrees to the amended general terms and conditions.

 
These general terms and conditions are drafted in the Slovenian language. The Luxe-Jeans website offers various language versions of these general terms and conditions, but the authentic version is the Slovenian language version. In the event of any doubts or discrepancies, the Slovenian version of the general terms and conditions will prevail.

 
If any provision of these general terms and conditions (in whole or in part) is found to be illegal, void, or otherwise invalid, such provision shall be considered deleted (either in whole or in part), and the remainder of the general terms and conditions shall remain in effect.

 
The customer guarantees that they have full capacity to assume the rights and obligations arising from these general terms and conditions and that they do not require the consent or approval of any third party for the performance of their obligations under these general terms and conditions.
